1. About These Terms

These Terms and Conditions govern your use of the Holmgren Design online learning
platform at hub.holmgren.com.au (“the Site”) and your purchase of and access to
any courses offered through it.

By creating an account, enrolling in a course, or using the Site, you agree to be
bound by these Terms. If you do not agree, please do not use the Site.

These Terms are governed by the laws of Victoria, Australia.

2. Who We Are

The Site is operated by Holmgren Design (“we”, “us”, “our”). For any questions

3. Your Account

To enrol in a course, you must create an account. You are responsible for:

– Providing accurate and complete registration details
– Keeping your login credentials secure and confidential
– All activity that occurs under your account

Notify us immediately at [email protected] if you suspect unauthorised access
to your account. We reserve the right to suspend or terminate accounts that violate
these Terms.

4. Course Enrolment and Access

When you purchase a course, you receive a personal, non-transferable licence to
access and complete that course for your own use.

Unless otherwise stated at the time of purchase:

– Access is granted to the individual purchaser only
– Courses are not to be shared, resold, or distributed
– We reserve the right to update or modify course content at any time

If a course or module is discontinued, we will endeavour to provide reasonable
notice and, where possible, an alternative or partial refund.

5. Payment

All prices are displayed in Australian dollars (AUD) and are inclusive of GST
where applicable.

Payment in full is required prior to the commencement date of the course. Your
enrolment is not confirmed until payment has been received in full.

Payment is processed securely at the time of enrolment. We use third-party payment
processors and do not store your financial information. By completing a purchase,
you agree to the terms of the applicable payment processor.

We reserve the right to change course pricing at any time. Price changes will not
affect purchases already completed.

6. Refunds and Cancellations

All cancellation and refund requests must be submitted in writing to
[email protected] with your name, order details, and the course concerned.

Self-paced online courses

You may request a refund within 14 days of purchase, provided you have not
completed more than 20% of the course content. A $80 administration fee applies
to all approved refunds. Refunds are not available after 14 days or where a
significant portion of the course has been accessed.

Live Online Courses

Live Online Courses have limited places. Cancellation terms reflect the impact of
late withdrawals on course viability.

More than 14 days before commencement:
Refund of course fee minus $80 administration fee

7 to 14 days before commencement:
50% of course fee refunded, or full course credit toward a future intake
(your choice)

Less than 7 days before commencement:
No refund. A course credit or place transfer may be considered at our discretion.

Non-attendance without notice:
No refund or credit

Place transfers: If you are unable to attend a Live Online Course, you may nominate
a substitute participant at no charge, provided we receive notice at least 48 hours
before commencement.

Course cancellation by Holmgren Design: If we cancel a course, you will receive a
full refund or the option to transfer to a future intake. We are not liable for any
additional costs you may have incurred (e.g., travel, accommodation).

Refunds are issued to the original payment method within 10 business days of
approval.

Nothing in these Terms excludes rights you may have under the Australian Consumer Law.

7. Intellectual Property

All content on the Site — including course materials, videos, images, text,
graphics, and design — is owned by or licensed to Holmgren Design and is protected
by Australian copyright law.

You may not reproduce, distribute, publish, or commercially exploit any course
content without our prior written permission. Personal, non-commercial notes and
summaries for your own use are permitted.

8. Acceptable Use

You agree not to:

– Share your account credentials or course access with others
– Record, screenshot, or reproduce course content for distribution
– Use the Site for any unlawful purpose or in a way that infringes the rights of others
– Attempt to gain unauthorised access to any part of the Site or its systems
– Post or transmit harmful, offensive, or misleading content

We reserve the right to remove access without refund if these conditions are breached.

9. Disclaimers

Course content is provided for educational and informational purposes only.
Holmgren Design does not guarantee specific outcomes, results, or professional
accreditation from completing any course.

To the extent permitted by law, we make no warranties about the accuracy,
completeness, or fitness for purpose of any course content.

10. Limitation of Liability

To the maximum extent permitted by the Australian Consumer Law, Holmgren Design’s
total liability to you for any claim arising out of or in connection with these
Terms or your use of the Site is limited to the amount you paid for the relevant
course.

We are not liable for indirect, incidental, or consequential losses, including loss
of income, loss of data, or business interruption.

Nothing in these Terms excludes rights you may have under the Australian Consumer
Law that cannot lawfully be excluded.

11. Privacy

Your personal information is handled in accordance with our Privacy Policy at
hub.holmgren.com.au/privacy-policy. By using the Site, you consent to our
collection and use of your information as described in that policy.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the
“Last updated” date at the top of this page. Continued use of the Site after
changes are posted constitutes acceptance of the revised Terms.
